Simply Amazing Charles,

It wasn’t until I read a few of the latest comments by some of you contributors that I became aware of the “Paid Duty” aspect of what happens at the legislature. I checked into this for accuracy and sure enough.

I had been wondering how it was that the Sergeant at Arms Dan Bussieres, had that much power over these police officers. The officers all appeared to be running and jumping like, “petit marionette.” I hadn’t really seen police officers do that before. “For such trivial matters as Charles’s existence on a piece of public property, when he really wasn’t doing anything other than clearly blogging / reporting news.” For a police officer to be enforcing a property ban, whether it was legitimate or not, seemed a trivial thing to be doing when Charles wasn’t doing anything. He wasn’t harassing any public servants. On every one of these encounters he was trying to capture a story from an MLA, so he could blog to the issue at hand. I now see why. If someone is prepared to pay off duty wages to hang around and chase away Charles, then I guess that’s why Charles has been confronted so affirmatively.

For the police officer the extra cash is great. That would be a nice “paid duty”. But it’s when the paid duty becomes a public disgrace for public viewing, like in the cases when Charles videos his encounters, that’s when the paid duty becomes something else altogether. (Nightmare)

The scenario will be on the Chief’s desk before morning. That’s the first thing the Chief does. He wants to know what happened over night that he is going to have to answer for. He needs this matter looked into and a briefing prepared so he can answer for it. This means the officer involved has to be brought in and questioned, and depending on the circumstances, the officer feels the pressure associated to the situation immediately.

For Officer Fred L’Ouiseau that nightmare came when he had to answer to the Chief, or at least the Deputy as to why he confronted Charles to the extent he did. He had identified himself as a police officer for Fredericton and of course the Blogged video shows the rest. (Chief wants answers) (No fun for the officer).... It doesn’t matter who is at fault here... The Fredericton Police Force have to wear the EGG, and shit flows downhill.

Let’s move on to the bicycle caper. >>>>>

Of course Police Officer Fred L’Ouiseau was calm and appeared professional. He was the instigator and he knew he was on video. He was getting his pound of flesh. Nobody said that Fred L'Ouiseau was a dummy. Far from it. He's no doubt cagier than a fox. But he's a punk for doing what he did, when he was obviously doing something else more important. He had responded with three other cruisers to another issue of no doubt more importance. He saw his victim. He also knows that Charles has issues with ADHD, and knows this is likely to set Charles off. Only punks do that, and of course if you were in a school yard you would be called a bully....

What I was surprised with, is that Charles managed not to do anything other than to run off at the mouth. He somehow regained his composure to some degree, and didn't get hauled in for disturbance. I'm pleased he didn't, but the fact is that the police bully had already gotten his pound of flesh (ticket) and he was happy inside.

Officer Fred L’Ouiseau had a good day that day, or at least for the moment. The Chief is going to see that blog and he isn’t going to be happy. I know what the Chief is going to say, and so do the rest of you. Here is the CHIEF.... “Why would you get yourself into a confrontation with Charles Leblanc, knowing full well he is going to make us look bad....”Real Bad”. And for what, “a bicycle infraction”, a municipal by-law violation.”

The Chief would be pulling his hair out.........LOL

Then we have the blow horn caper. The Fredericton City Police were not going to do a darn thing until the complaints came in from across the street and they had to act. That’s why they bargained with you Charles. I don’t think they were really trying to put you away. It all looked bad, when you ended up spending a few days for that one, but at least they made up for it when they helped you out with the plea bargain. That’s not a matter to appeal. That’s a situation that you should thank your lucky stars. It’s now over and you got nothing.

The next issue is where you have the right to stomp your feet and more and I’m glad you have.

Right or wrong, I believe a pattern has developed, that the Fredericton City Police are going to have to apologize for.

They have allowed the emotions of one of their officer's to boil over and create this mess. He is the person who lodged a complaint against Charles. Without his complaint they wouldn’t have gone near you. It obviously wasn’t looking good for the police officer, who had to explain his foolishness to the CHIEF at least twice now.... He's pissed now.

Freddy olde boy has no doubt been blaming this whole thing on Charles and has been stomping up and down that he was called a ??????, a quebecquois, a facist and a gestapo, but is totally unprepared to take any heat for his actions. That’s the behaviour of a school yard bully.

He got off on the complaint that was made by Charles that he .... Charles in the ....., but he knows this is going to come back up in court on traffic ticket day....

Now... How does Officer Freddy L'Oiseau have that much clout over the FPF for them to pull last weeks escapade???.... I’m not sure what the answer for that one is, but it’s there. Common sense says it has to be. Did the CHIEF not know or was he away.....??? One thing is for sure, he has been answering for it ever since.

For the Chief , it would be “no backing down now troops. Half of his police force was involved in this faux pas and we look like hell.

That is an answer for the courts I guess... Over zealous police forces or police officers are crucified in the courts on matters like this and the Dept of Justice knows that.

Do they think all of the evidence won't come out? The police may think they can compartmentalize these issues, but the truth is everything will come out and regardless of how and what Charles looks like, the police look just as bad. They are the ones in authority and clearly they have bullied Charles this last few time. It’s on tape. The complaint doesn’t lye. It was L’Oiseau that lodged the complaint.

Not a good case to take to court, I assure you, and on the balance of probability as to conviction the DOJ will shut this down, if they haven't already.....

I know they don't run the investigations but they don't like the bad publicity.

They will likely wait until April for the court date to arrive and then try and plea bargain with Charles.. "But not this time"...

The Fredericton Police can recover from this, I’m certain. They need only stop what they are doing. They need to conclude this matter as unfounded, just like they did with Charles’ complaint of getting kneed in the ....... They need to look Officer L’Oiseau in the face and set him straight on the facts of real life. If they don’t do it today, how are they ever going to control this officer in the future. They don’t have to tell anyone how they dealt with their employee. They just need to conclude this right now. Court Day will be too late....... more later......

Alward delivers 2012 State of Province Address

FREDERICTON - Premier David Alward delivered an optimistic, but tempered State of the Province address this evening at the Convention Center in Fredericton to a sold out crowd of 900 ticket holders. The event was sponsored by the Fredericton Chamber of Commerce in concert with the Telegraph Journal and smaller businesses.

The crowd mingled to the tune of "Fix You" by Coldplay until the lights went down at 8:30 pm for opening remarks by Andrew Steeves, President of the Fredericton Chamber of Commerce and Robert Warner, head of Brunswick News and the Telegraph Journal, who introduced the Premier to the stage.

Warner, new to New Brunswick and his post at Brunswick News, echoed much of what has already been discussed regarding the province's dire financial situation since Alward came to power.

"The Alward government has taken the reigns of government at a terribly difficult time in this province," he began, blurring the lines between media and politics by going on to parrot rhetoric heard on both sides,while trumpeting the Telegraph repositioning itself behind an online paywall as, "...the first step on the long road to tomorrow."

Alward's speech was as much a report card on the work of his administration for the past 16 months as it was cheerleading to buck up the populace for the hard economic road ahead. It focused on the necessity of innovative business vision, balanced with fiscal responsibility, to pull the province out of it's economic quagmire.

"We have a lot of work to do, we can get there together...the government will assist and help, but we are not job creation experts or a bank...we will foster an environment to succeed...but the rest of the time we will get out of the way," he said.

The presentation began by pointing out the triumphs of prominent home grown business visionaries, including Wallace McCain and Ian Fowler, as take charge New Brunswickers who embodied the achievements the province's citizens are capable of.

But that confident opening was also offset by addressing the painful ways the administration will have to address a ballooning debt such as highway tolls and HST increases (through a referendum or election), pension plan adjustments, consolidating local governments, changes to the Official Languages Act and integrating government departments.

"Our economy is tied to the rest of the world...the U.S. economy is shaky and that affects us. 2011 was tough for the New Brunswick economy," said Alward.

The Premier outlined ways the government has already taken steps to provide a scaffold for some businesses in the province such as a fuel tax exemption for farmers and lower energy rates so money can go back into business operations elsewhere.

"...natural gas distribution rates were changed to fix a flawed system in New Brunswick [creating benefits] to pass on to New Brunswickers, to the economy, jobs, businesses and consumers," said Alward.

Innovation weaved it's way throughout much of the presentation, used as a by-word for dynamic business solutions to the province's economic woes, while at the same time meant as a prescriptive for doing more with less.

"Innovation is the rocketfuel of our economy," he said, citing the information and communication sectors as areas the government wants to help foster growth.

Although no concrete framework was announced, Alward outlined other areas the government will help to prosper including, aerospace, bio-sciences, industrial fabrication and value-added food.

"We are investing 250 million over four years across the province," he said, while teasing the crowd with hints of a coming announcement by Invest NB on new jobs to the province through a pharmaceutical and medical supply company McKesson.

The Premier said the government will continue to provide services in core responsibilities such as health care by looking at best practices to prioritize where to put money.

"Services and programs are being reviewed for appropriate affordability and sustaining services for New Brunswickers," he stated.

Other plans were also mentioned for paring down the debt by decentralizing economic development to regions around the province, letting local communities decide how best to help local businesses.

"Aspects of change are coming to small communities...there will be negative results if we don't go forward," he said.

With shale gas exploration a major issue dominating the headlines in the past year, Alward addressed the province's natural resources, saying the potential for a shale gas industry in the province an economic driver behind the overall economy in the province to create jobs. However, he stressed, it will be regulated for safety.

"Responsible development of natural resources in New Brunswick will not sacrifice clean water, clean air or clean soil...[there are] strong regulations to protect the environment...a strong regulatory regime for oil and gas exploration. There will be no tradeoff in the protection and safety [of the environment] for economic gain." he said.

Alward went on to point out that in his State of the Union Address, President Barack Obama stated the shale gas industry a massive job creator for the country.

After taking some scripted questions from a few business owners via video, Alward finished up his address saying the last major review of government services was done over 40 years ago and since the debt has grown to 9.4 billion, a strategy to do a new overhaul is required, for which a panel has been struck and will be announced next week.

The Premier left the stage to the dynamic sounds of "Clocks", another Coldplay tune, giving a hopeful impression of his administration's future management of New Brunswick.

"Police Officer Fred L'Oiseau ends up on Charles Blog again... "A real bad Ego Buster" and a complaint against the officer for kneeing Charles in the privates.

That's not looking good for the policeman.... He's pissed now.

I'm not sure but he has likely been off on some sort of administrative or medical leave.

Native might have saved Blogger life when Fredericton Gestapo Police Force raided Blogger's Home!!!

Ok...I believe it's time for this Blogger to write a little Blog about the Fredericton Gestapo raiding my place last Thursday!!!

January 19th started very good. My Native friend knocked at my window and asked me if I wanted to go at Tim's Horton for a coffee?

Away we we went!!

I suggested to her that she comes inside my place? It would be the very first time she has ever been over my home.

Once inside, she sat in a cozy chair.

She was relaxed and we chatted. It began to get warm so I went to open the curtin of my window.

I sat down and minutes later, I said - WHAT THE FUCK?????

I noticed 8 to 10 plain clothes and uniform Cops walking very fast past my window.

I never saw so many Cops in the area of the City!!

I quickly went for my weapon...

Opppsssss I meant my camera and quickly proceeded to video the action outside of my place.

But little did I knew that I was the action.

They had the key of the building and proceeded right to my door.

Well....it must have been a rush for my Native friend because she quickly stood from her chair and out the door she went.

GONE AND VAMOOSE!!!

Don't blame the poor girl....

So....there I was alone with 8 to 10 cops in my little place.

If I would have been alone? I could have been seriously injured. I'm surprised they never assaulted the Native girl because I did hear the Fredericton Cops were racists against the Natives.

These guys reminded me of the Gestapo!! They were Stone-face like the Nazis!!

It was like I was the enemy!!

I asked - What is this all about???

They told me that it was a Libel charge laid by Police Officer Fred L'Oiseau against the Blogger!!

I quickly shot back - Isn't this suppose to be a civil matter??? You know...a lawyer would send me a letter in my mailbox???

With a smile Racist Cpl. Bobbi Simmons-. Beauchamp told me that it was a Criminal Charge and they have to search my place!!!

I asked - Listen???? Can you bring my neighbor from upstairs in here so she can watch you guys??? I don't want you people to post Child Porn pictures on my computer!! I DON'T TRUST THE FREDERICTON POLICE FORCE!!!!!!!

They answered - Nope!!!

They proceeded to put the handcuff behind my back but I reminded the cops that I had a bad shoulder.

They said - Since we know you? We'll handcuff you with your arm in front of you.

Once again as my arrest with the blowhorn last summer. It was the same cop in charge of my arrest.

It was racist cop Cpl. Bobbi Simmons - Beauchamp!!!

She asked me if I wanted my rights in French?

I answered - You know what? In a situation like this? Yeah!!! I'll have my rights en Francais!!!

This stone-face gestapo cop came along with the name - Carter on his jacket.

I said to myself - Carter???? Francais????

He took a deep breath and began reading my rights. I quicky stopped the guy and said- EN CHIAC!!! JE PARLE LE CHIAC!!!

Sigghhhhhh.....

They wouldn't allowed me back inside my place!

I asked my my medications!!! At first, they wouldn't give it to me but I'm certain they remembered of the public uproar once Staff in the Jail in Saint John denied my medications.

They allowed me to have my medications and to jail we went!!!

It was embarrassing to be escorted in handcuff where everyone can see ya!

Once in jail, they explained to me the charges and put me in a very cold cell!!!

It was like a Gestapo style Squad at the Police Station. Guys like

They guys used to talk to me but this time around they were Stone-Face like Nazis!! They looked brainwashed! They looked at me as I was a piece of shit!!!

Very strange......I will never respect these cops again in my life.

I shot back - You're not racist....YOU'RE GESTAPO!!!!

To the cell I went....

So what do you do with a person with ADHD in a jail cell?

This was beginning to be a habit!!!

All this because of a bicycle!!!

Hours went by and I was wondering what just happened??? This must be a huge nightmare??? Nope!! It was the real thing!!

Others were in Jail for some break and enter issues.

I began to do some sit ups in the cell. Hey? What better way to get in shape?

For hours, nobody came and talk to me until one Acadian Yves Despres came to the scene to speak to me En Chiac!!!

He bought me to a room on the 3rd floor and began asking me questions!!

Such as - Who asked me to become a Blogger??? Who has my user name and password??? What was the name of the girl in my place when I was arrested?

All these questions are useless anyway because the minute I was arrested and bought to jail? I said on camera - Anything I say cannot be held against me because I have ADHD and I speak before thinking. Therefore you can't use what I say in court.

He continued by saying that I should have called the Cop a bad word???

I shot back - HE SHOULD HAVE DID WHAT HE DID!!!!!!!! < More in details >

I felt like I was in China!!!! Bloggers are shot in that country!!!

So...at the end he bought me back to the Jail cell!!

I laid down on that cement bed and suddenly I got huge pain in the the left side of my side!!!

I quickly called for the guard and she quickly came.

I had my arm up and couldn't move!!!

5 minutes later < took a long time > Matt Myers and others came to see what was going on???

I said - I guess I'm going to die a martyr Blogger!!!! You guys have been trying to killed me since last summer!!! Bye bye cruel world!!!

I felt like Redd Foxx taking the big one!!

You should have seen the looks on these Cops face. They changed from Stone-Face to concern. Can you imagine if the Blogger would have died behind bars?

WOW!!!!

At the end, it was muscle spasm < I think? > on my side from doing these sit ups!!!

Minutes later, I was escorted to an area where I was finger printed and photograph like the criminal the stone-face gestapo Cops believed I was!!!

Then we came to the part where the cops forced a person to sign papers to the point that you'll be release from custody!!

Conditions are important in this case such as the last time the Prosecutor wanted me to signed papers not to be at the corner of Westmorland and Queen Street. I told Judge Julian Dickson that I wouldn't signed those papers because I have to cross the Westmorland Bridge to go to the North Side. I had to used the Westmorland Bridge.

The Judge ordered me in Jail for two days and the Gestapo ordered my medications be cut off. I could have taken a stroke.

Conditions in this case? I can mentioned the name Fred L'oiseau but I can't used his picture or condemn him.

I started to walk toward the cell and said - Lets go to Saint John < Jail > I guess? I'm not signing any papers with conditions.

After around 20 minutes of debating? With no lawyers around to help me decide? I signed the papers.

Someone called the cop and asked if I agreed to the conditions?

The Cop replied- IT'S DONE!!!!

I left the Police Station and made an interview.

I arrived home and I was surprised that all my stuff was gone from my place. They took everything!!!

A code on the wall, hard drive, keyboard, external hard drives, speakers and modem!!

I was confused of the reason they would take all these items???

I returned to the Police Station and demanded some answers???

They told me they could keep all my items after my case is done in court.

Well....I was like a lost dog without its bone.

I came and felt that my privacy have been invaded.

Then I began to think about what the Gestapo Police Force could see in my computer.

All my contacts with the Government, friends and foes.

Will the Fredericton Gestapo begin to arrest my friends???

Will other charge follow????

The word soon spread on the information Highway that the Blogger was once again arrested by the Fredericton Gestapo Police Force!!!

Someone showed up over my place and told me that I could have his computer!!

I reminded the guy that I didn't have a modem! It was no good to me.

The next morning the arrest was all over the News.

Different people from the media circle showed up over my very dirty place....

Friday evening, I didn't have a computer in my place and I felt like a lost puppy.

A buddy figured that I would be having a hard time so he invited me over his home for a meal and beers!!!!

Even sent me home all drunk up with two bottle of wine for me to enjoy!!!

The next morning, I arrived at the Farmer's Market a little late. < Some vendors were worried because they believe the cops arrested me again >

I quickly found out that many people asked me if I had a computer? People wanted to help. The citizens were very very very upset with the Cops!!!

From the high profile people to the less fortunate. Everyone wanted to help me get back on line so I could continue blogging.

Someone came over with a modem with a message to the Gestapo Cops!

People were giving me money on the streets!!

I told the concern citizens that I was ok and lets see what's going to happen?

The stories was in all the media!!

Monday came and people were still talking about the arrest, They just couldn't believe it.

The media once again came over my place to do a follow up!!!

I received many emailed from people who wanted to donate a computer and money!!!

I was told to go at the Post Office at Shopper's Drug Mart at Kings Place.

Once there, there was a little lined up. I asked the Pharmacist if the media could video me for a few minutes inside the drug store. He agreed!

I noticed a male snob in front of me. He looked very uncomfortable with all the media in the area.

I said - Can I go ahead of you. It will only take a few minutes.

He said- This is just bad timing from my part. I believe that I'll come back another time and he left the area.

I was surprised when the Postal worker told me there was $300.00 in there!!!

It's issues like this that keeps this Blogger going!!!!

In case you haven’t already heard, blogger Charles LeBlanc was arrested and charged with libel. Many people have questioned the validity and applicability of the charges. This blog post isn’t going to do that, instead, we will be discussing the seizure of computer equipment for “evidence”.

During the raid, they took his computer, monitor, speakers and cable modem. None of these were actually required as evidence, not even the computer.

Charles’ blog is hosted on blogspot.com, a Google service. His computer has nothing to do with serving web pages. During a normal investigation, the police would subpoena Google to get the IP address of the poster, then subpoena the Internet Service Provider (ISP) to get the owner of the IP address’s account. That is all that is needed as proof. Even with the PC, there is no way they can get any more proof that it was actually Charles sitting in that chair typing those words. In fact, assuming he used the online post editor, there would likely be no trace at all on his computer. Even if they needed to access the computer, there are forensic tools available that will make an image of the hard drive on-site, without the need for a complete seizure.

This is clear evidence that our court system does not understand technology at all. This will be abused. We now know that someone can have IT equipment removed at the mere accusation of libel. How often will we see this being used as an intimidation tactic?

I like Charles Leblanc have suffered at the hands of members of FREDERICTON CITY POLICE, who did without Court issued search warrant, since year 2009 Criminal Code 'Break and Enter' my at 31 Marshall Street, City of Fredericton, these incidents occurring at my home more then one occasion.

Each occasion I was attacked physically injured, each occasion
I have observed members of FREDERICTON POLICE FORCE searching through my residence, opening furniture drawers and or doors.

I do not have a criminal record now, nor have I ever.

Yes, every day I must reasonably fear for my safety as members of FREDERICTON POLICE FORCE attacked me and arrested me several times apparently because I was riding a bicycle without wearing a helmet.

Police bicycle attack incidents cause me Physical injures.

Imagine being attacked arrested and physically injured,thereafter, necessitating medical treatment and prolonged therapy, simply because I was not wearing a helmet while riding my bicycle.

I have never been subsequently approached by these subject members of FREDERICTON POLICE FORCE to apologize or to reassure me in anyway, whatsoever, that these actions against me will stop.

To the contrary Chief of Police Barry MacKnight in response to my complaints filed with NEW BRUNSWICK POLICE COMMISSION writes letters to me confirming the arrests et cetera yet continues denying members of FREDERICTON POLICE FORCE have done any wrong incredibly states that
I am or must be amongst other things and I quote "Their mistake was made in good faith... "

Who's Defending Who?

When a person takes the oath of office to become an elected official, they agree to be judged for their service. When government does something, they will be judged. When government doesn’t do anything, they will be judged. Over the course of a term, they accrue a tally of hits and misses that are finally taken to the electorate and the voters present a ruling. Maybe they are rewarded for their work and re-elected. Maybe they are punished and replaced. An election is society believing that governments should be held accountable for their actions and the citizenry play a critical role by inquiring about the quality of governance they are receiving. The world has seen terrible ideas rejected through this process, and great ideas reinforced.

Long ago, people would only have personal encounters and stories from friends to base their judgments on. Then some societies opted to protect people that convey the activities of governments such as the press. The citizenry received access to government behavior through the media and improved their ability to draw conclusions and form judgments. Democracy was strengthened. Blogs, Twitter, YouTube and Facebook created the most recent explosion of how information is conveyed and presented. Nearly everyone has a cell phone, and most cell phones have cameras and recorders. Pictures, videos and audio-bits capture live events, and people seek to understand what they see and hear. The proliferation of technology has taken us from blurry encounters with government, to intimate interactions where experiences can be relived by millions of people across the world.

The Arab Spring showed us that democracy is desirable when compared to the alternative. We currently see no societies attempting to revolt against democracy. Just ask yourself how many nations that reject democracy are enticing enough to give up living in Canada for good. Generally, the world has improved greatly with democracy. People want the opportunity to change what isn’t good and hold onto what is. This is advancement. What is critical to this equation however, is the need to have space for whistleblowers. Democracy needs a society that allows people to say they don’t like the way things are going, no matter how correct or incorrect the subject of criticism might be.

Underpinning all of this is the courage of the whistleblower; the person who challenges the state because they expect a higher standard from their government. Maybe it is a journalist, or maybe a citizen with an experience. Maybe it’s just an observer. Maybe it is a blogger with a video camera.

But what happens when government, the monopoly of force, no longer wants to be criticized? What happens if government acts against that individual to send a message to them and others who may follow? What happens when governments stifle dissent?

I consider what occurred recently in Fredericton, New Brunswick, the city where I serve as a City Councilor an attack on free speech and the ability to challenge government. Local Blogger Charles Leblanc had his home raided and computer seized by the Fredericton Police Force under what is expected to be the charge of defamatory libel when Leblanc appears in court on April 20th. 2 years ago, Leblanc caught some questionable interactions near the tannery on tape and posted them online. I say questionable, because like myself, many people were shocked by what they saw and wanted an explanation and a court case provided those answers.

Leblanc has been an activist that calls out government on what he thinks is wrong. His comments are colorful and in some cases kooky, but they never incite harm. Why then is the police force flexing muscle 2 years after the incident in question? I have my suspicions, as I am sure that you do as well. Imagine for a second that it was not Charles Leblanc. What if it were a famous humanitarian challenging the police for their actions. Now imagine the humanitarian is taken to task on libel by the very government they were challenging. Wouldn’t we cry bloody murder? We all know government screw up, but from my experience blatant wrong-doings aren't always so. Sometimes things happen that require explanation. But if no one says "hey, wait a minute", the no one gets the explanation. In either case, everyone benefits from having the accountability. The challenge from activists like Leblanc produce either corrections, or explanations. Both are desireable in my books.
Now sure, Leblanc has frustrated a lot of people, but I believe in his sincere goal: he wants tomorrows government to be better than todays, which according to his plan, should be better than yesterdays. Prior to this whole fiasco, he referred to the police as being fascist and operating like the KGB. It sounds crazy coming from him on his bright picket signs, but now it’s less funny

I mean, what are the police doing to show us he’s wrong?
Regardless of the legitimacy the pending charge may have, the damage done by this type of behavior on the part of the FPF could prove to be substantial. Whether it was intended or not, the City of Fredericton is sending a message that nuisances will be silenced, and that people should think twice about taking on the state. After all, if this isn’t a message, then why send 8 officers? Raiding in a situation where literally, the crime is badmouthing someone seems excessive.
The term “libel chill” is used to refer to the effect the laws on defamation have on societal discourse by scaring off harmless and valuable objections. As mentioned, a critical component of effective democracy is the ability to dissent and speak your mind. If people never promote issues to challenge, then government propaganda will be the news. If governments target those who raise flags, people will be too afraid to challenge governments when they’re off mark.
I find this type of behavior to be morally reprehensible and a giant step back for political discourse in Fredericton. We’re all fools if we don’t think the next journalist to call out the police isn’t going to be looking over their shoulder. What does this mean to the quality of information we receive if our journalists are worried about the police? What happens when we make increase the risk of exploiting things that should be talked about and challenged? The stories of governments silencing critics are supposed to trigger stories from the Soviet when challengers disappeared and opposition was intimidated to stay silent. They were not to be reflective of experiences in Canada.
All the progress that we enjoy here in Canada is because of the fact that we have people that can fearlessly stand up and demand better. We have people working to uncover the stories that people don’t want to be told. By protecting their ability to be journalists, or even lunatics about the issues they care for, the pressure remains on the politicians to work toward the goals of the voter.
I personally stand by Charles Leblanc and the important role he plays in politics. We are lucky to have the freedoms we enjoy, but when they come under attack in the most subtle of ways, that is the time to double down and take them back. I chose a world where Charles Leblanc does exactly what he does, especially if the alternative is that government becomes silent to criticism one dissident at a time. There are times when I loathe the very comments he posts, but every November we celebrate the hero’s the lost their lives defending his right to do so.
If the reputation of anyone was truly damaged, have a press conference or do an interview with the media to restore the lost image. This issue needs to be put to bed and sanity needs to be restored to the whole situation. We teach our children in the “sticks and stones” rhyme that name calling shouldn’t hurt us. Let’s maybe for a moment believe it ourselves and stop using force to silence critics.
To paraphrase F.A. Hayek, if you only want freedom when you like the outcome, then you don’t believe in freedom.
Let me leave you with the title of this post: who is defending who? The police are here "to serve and protect", but this act isn't serving anyone but the force itself.

"For a couple of years now I've followed, very passively, LeBlanc's adventures. I first looked him up after he approached me when I was living in Fredericton and I couldn't stop internally laughing at his blogger jacket and hat. I had to read his blog, so I did. It was exactly what I expected - rambling, sometimes incoherent, often paranoid viewpoints on NB and mostly Fredericton that only someone with a tremendous amount of free time on their hands could produce. I mostly considered him a crackpot.

However, LeBlanc has had a few interesting and, I have to say, _important_ moments in his crackpot career. At Atlantica he raised public awareness about what it means to be a private journalist and how independent reporting has become a part of modern life now that literally anyone can circulate their work to anyone else in the world. He raised some very serious questions with me about how our provincial legislature is being run. He's been banned for life from our provincial government forum and for what? Civil disobedience and protest. You don't have to agree with what he was protesting or even respect it, but you _must_ respect his right to do it and you must respect the rights of the citizenry to participate in the political process.

There are several other concerning developments that I don't have space to go into. (Receiving a minor infraction ticket after the fact due to a 'report' from a citizen? Come on)

Yesterday morning, I was relaxing with a lady friend inside my place.

Minutes later, I noticed 8 to 10 plain clothes and uniform police officers walking beside my place.

I never so many cops in one area!!

As the Blogger that I am? I quickly went for my camera and proceeded to run outside to follow the action.

(Fredericton, NB - January 19, 2012) - In a startling new development today in the case of well known blogger Charles LeBlanc, Fredericton City Police raided LeBlanc's downtown apartment and confiscated all his computer equipment including his monitor, external hard drive and Rogers modem, effectively shutting down his ability to update his website, charlesotherpersonality.blogspot.com, from his home.

In today's incident, Fredericton Police also laid charges of libel under Section 301 of the Criminal Code of Canada, claiming that LeBlanc libelled a Fredericton City Police officer in a blog posting last summer.

"I can't say anything more about it. The police told me I'd spend the next four months in jail if I mention the officer's name. I'll lose my apartment and end up homeless if I go to jail for four months."

Mr. LeBlanc says he caught completely off guard this morning when eight police showed up at his doorstep around 10 am. He was handcuffed, arrested, fingerprinted, photographed and jailed for close to six hours while the police went through his apartment looking for evidence of libel.

During his arrest, LeBlanc says the police asked him for the names of people who helped him with his blog.

"It's very scary stuff," says LeBlanc. "They asked me if anyone helps me with my blog, and if anyone has my username and passwords. They even wanted to know who approached me to be a blogger. Does that mean anybody who associates with me will be arrested too?"

The arrest comes on the heels of Mr. LeBlanc pleading guilty Monday to causing a disturbance last summer in front of the Fredericton City Police station. LeBlanc used a blowhorn to publicize his concerns about the unequal treatment of the poor by the City Police.

Mr. LeBlanc pleaded guilty to the Criminal Code offence Monday after consulting with friends in the social justice community who convinced him that it would be the best thing to do. He received no legal advice and there was no duty counsel available to speak to him on Monday.

"I was in a tough spot so I listened to my friends and pleaded guilty just to get it over with," says LeBlanc, "But right away I knew something was wrong and I decided to appeal. I even blogged that I was going to appeal it."

LeBlanc says someone told him that the police were going to grab him on the street as soon as he pleaded guilty on Monday, "But I didn't expect it to happen so soon and I certainly didn't expect them to raid my apartment, take all my computer equipment and threaten me with arrest and jail if I dare to mention the officer's name. It's like Soviet Russia."

A Fredericton activist, who asked to withhold his name for fear of retribution, criticized the Police move.

"All this is being done to prevent Charles from going to trial on the bicycle issue (riding his bicycle on the sidewalk) and the reason for that is because they want third party vigalante reporting so they can arrest other people on trumped up charges. Poor people have had this for a long time, single parent women who have been anonymously reported by neighbours because their kids are dirty or under-dressed, the kids are taken away from them and they have to prove they are fit. The only difference is that in Charles' case, they have this high profile guy, Dan Bussieres, the head of security at the legislature, who allegedly made the anonymous complaint against Charles. The police don't want that to come out. We can't have vigalantism in a democratic system, everybody reporting on everybody. It's extremely dictatorial and besides, who are the police to decide what journalists and bloggers say.it's a matter of freedom of speech and boils down to this: do the police have the right to eliminate opinion they don't like? What is this China?"

Ever since my cousin Paul LeBlanc died last August.

My Aunt and Uncle have been in tears every day since...:(

But last evening everything changed.

What got me thinking was when the owner of the blowhorn went at the Police Station and asked for his little toy back.

They refused and told him that they will keep it for 30 days!!

I'm thinking of appealing the verdict I received in Court on Monday.

I do have 30 days to think about it....

The reason that I'm concerned is I heard the Cops are ready to grab me from the streets for any reason at all and lock me up in Saint John.

So? If this is the case?

Why not have a trial???? At least the facts will come out.

CBC Journalist Nicolle Carlin is doing great!!!

I chatted with Nicolle today on the streets and Things are going ok, but its taking a little longer than she thought to straighten out her thyroid problem.

She had a radio active iodine treatment that is suppost to kill off most of her thyroid cells, and unfortunately it doesn't seem the treatment worked.

That means she will likely have to do a second treatment but they like to wait 6 months in between.

There is still a chance that the first treatment will have an impact so our fingers are crossed,

In the meantime she's ok, not dying or anything, just not feeling great...extreme fatigue and aches and pains but there are some good days mixed in with the bad.

She'll be back in better shape then ever!!!!!!

The issue is not that. The REAL issue is the fact that you weren't given a lawyer.

If a person is not given a lawyer then they obviously represent themselves and THEN should be given those answers.

If you have a procedural question, then you had several months to get your questions answered. You could go to the courtroom and watch other cases, and the internet is filled with information.

I'm not letting the government off the hook. I remember when they ran that guy out of town who was helping the less fortunate but wasn't a 'registered lawyer'. That is criminal. If a person doesn't have a lawyer then the government should do as they do in other jurisdictions and provide telephone or email legal help. THAT is the issue, because as you say, many people are simply overwhelmed by the court process. It's criminal that at no point in a public school education are people taught what canada's legal system is like.

To be honest, I'm still not sure what 'questions' you are referring to. If its "why don't I have a lawyer" we already know the answer to that-the province simply doesn't have the money to supply every person with a lawyer. In fact, you could have appealed and sued if you WERE given jail time, because the province (I'm pretty sure I read this) specifically stated that people WOULD be given a lawyer if the charge was serious enough to result in jail time.

If you have a procedural question then there is no reason why you could not have answered that yourself in the many months leading up to the court date. If you have a specific question for the police, then that is what testifying is all about. You said that the police were calling no witnesses, which is another tip off that they weren't serious and you COULD have gotten away with a 'not guilty plea'.

If there are no witnesses, then how does the court know that you used a bullhorn at all? I don't know whether arresting officers are called 'witnesses' or something else, but in either case, if they WEREN"T being called, then all you have to do is ask the judge "if there are no witnesses, then I plead not guilty".

As I said months ago, IF they called the officers who arrested you to the stand, THEN you get to ask them questions to verify their testimony. At that point you could simply ask the officers why they didn't simply seize your bullhorn instead of arresting you.

The one reason that I wish you HAD pled 'not guilty'-even though you clearly were, is that as another poster said, the 'less fortunate' would have more details about the court system and what may ultimately happen to them someday.

I can't begrudge you for that though, years ago I though a video or animation could be done showing the step by step process and didn't exactly rush out to do one, so nobody should expect somebody else to ride out the legal system for a cause when its not necessary. If anybody knows such a video or site, they should post it here.

Now the battle turns against the Justice Department for some answers!!!

Especially the Judicial Council < Judges of New Brunswick > saying that people with mental disabilities are not allowed to asked questions in court.

I had over 1,000 visitors in this Blog so far today so I guess many readers are anxious to know what happened and how I came to the conclusion of pleading guilty?

Here we go!!!

I left my place and walked by the Racist Police Station this morning.

I showed up at the Justice Building at 9:15am!!!

Immediately after walking through the doors, I was greeted by a Police Officer who wanted to talk to me.

It had nothing to do with my trial. He wanted to tell me that Wayne Steeves couldn't be charge for Jaywalking because the walking lights are near-by. < Something like that >

I proceeded downstairs and there were hardly anyone down there but lots of Police Officers. I wasn't comfortable in staying downstairs so I went back upstairs and was greeted by a few supporters.

We went downstairs and were approached by Sgt Matt Myers.

He asked me if he could talk to me alone?

I knew it was bargaining time!!! Time to talk and debate before the Trial.

I don't understand why they don't debate a week before the courts date?

I told the Officer that he could talk in front of my three other friends who were watching the situation very very very closely!!!

He asked - What do you want? What am I going to plea? and other issues. It was a little nerve wracking because there were a lot of walking and action in the area.

He left to chat with the prosecutor.

I told my friends - This is it!!! The debate before the trial. But I was holding firm.

Another officer came and it was the guy that I threw the disclosure out the door. He too wanted to know what I wanted? Or could I be open for some sort of a deal? Can we talk???

I reminded the officer that no one have made a effort to talk to me since I have been arrested.

There is no communication whatsoever!!!!

The officer left and said that he was going to contact the prosecutor.

People were moving ADHD fast!!!!

The Prosecutor came < I forgot his name >

He sounded like a nice guy and not the same attitude as the other prosecutors that I had to deal with in the past.

I suggested we sit in a room to discuss our issues so three floors up we went and the debate began.

He told that he wanted to suggest to the Judge that I get a suspended sentence, no blowhorn for 6 months and community hours.

I asked about the other charge of the Blowhorn but that's a by-law infraction. < $250.00 fine >

He wanted to know if I would agree the terms?

I reminded the prosecutor that I remember a deal was reached between strikers at the Refinery and the prosecutor a few years ago but at the end? The Judge went against the strikers!!!

If they had to do it all over again? They would have never pleaded guilty.

I was afraid that the Judge would do the same because I did put a complaint against Judge Julian Dickson.

I asked the prosecutor and Police officers to leave the room while I chatted with my supporters in private.

So the debate began. What should I do?

Every single one of my supporters told me that it was a good deal and I should accept it!!!

Myself? I wasn't that certain. Something was telling me to fight this one in Court.

But I had three supporters telling me to take the deal the prosecutor offered.

I asked - Can I leave this Court House with my head high if I accept this deal?

Anyone knotted their heads and said Obsoletely!!!!! No shame whatsoever!!!!

I didn't have hours to decide of what to do? I had 5 minutes max!!!! Decision ..decision...decision!!!

I said - Ok.....Majority rules I guess.....

I also recalled a high profile activist told me in my last court appearance that I didn't need this shit and there were many more important issues to fight. Make a deal and get the hell out of here!!!

So...in court we went and I sat behind the defence table while the prosecutor took the other table.

It didn't take long for the Judge to come out!!!

She asked if we reached some kind of agreement? The prosecutor told the Judge we did.

He began to mention the victim impact assessment.

At the moment, I quickly interrupted the Prosecutor and suggested to the Judge that this wasn't part of the deal.

I mean...if we're going to have witnesses telling the Judge that she couldn't sleep at night and begins crying in the courtroom.

I would rather have a Trial?

The Judge quickly adjourned the hearing and seconds later the Police officers said - No one is going to testify!!!

Must have been one of the quickest adjournment on record!!! 2 minutes or less!!!

The Judge explained to me that the Prosecutor will read the comments of the complaints and I'll have my say afterwards.

The prosecutor had his say and I had mine.

I did mentioned that maybe from now on? The Police might take complaints from the less fortunate a little more seriously???

The Judge gave me a suspended sentence and I don't touch a blowhorn for six months and perform 20 hours of community work.

Once it was over, a supporter shook my hand and told me that I spoke very good!!!

Afterward, we had a little problem but I don't believe it will cause any trouble.

So? That's the story!!!!

What would have happened if a trial would have proceeded? Not sure!!!! I wasn't ready for a trial because I had many questions.

But my supporters urged me to accept the conditions of the Prosecutor so I did just that!!!

Was it a huge mistake?

Time will tell.....

My Family emailed me last night and told me that I made the right decision!!!

One thing is certain? I will continue fighting against issues that I feel is not right!!!

Now you know the rest of the story!!!!

Since I received that letter on Friday afternoon from the Judicial Council telling me that my complaint was denied and the case is close!!!

I predict that Judge Julian Dickson who sent me to jail will show up as the Judge this morning!!!

Now...wouldn't that be a conflict of interest???
