IT WAS EXACTLY ONE YEAR AGO THIS MORNING AT 10:30AM THE RACISTS MEMBERS OF THE FREDERICTON POLICE FORCE RAIDED MY PLACE UNDER THE CHILD SEXUAL EXPLOITATION ACT!!!!

Yes, how time flies and I'm getting a VERY sick feeling in my stomach when I go back one year ago and to think those Cops went under the Child Sexual Exploitation to get a search warrant to raid my place.

I was shock when I heard that Saint John Councillor Donnie Snook was arrested for child porn.




I said to myself - Hey? Wait a minute!!! He's very outspoken and maybe just maybe the Cops used that section just to search his computer??? You know just like my case.

This would enforce the issue to have a Public inquiry on the way the Cops gets a search warrant to search people's home.

But unfortunately, this wasn't the case and Donnie Snook will get what he deserves and that will be years in jail!!!!

The Cops searched and spent thousands of dollars going through over 250,000 pictures on my hard drives but they didn't find any child Porn!!!!!!

If those brain dead steroid bastards would have investigated a little more? They would have found out that I hate Kids!!! I can't stand the little bastards..never mind looking at naked pictures of them!!...Siigghhh...

But I must asked this question - If happened to me so how many other people in Fredericton this happened to that we will never see the light of day in Court or in the media???

The Racists members of the Fredericton Police Force and the R.C.M.P. searched all my info and read all my emails of my contacts and I'm surprised they were surprised of how many powerful contacts I do have???

Bernard Richard came out with his report and it was all screwed up!!! I will blog his report later this week. The Police lied to Bernard Richard and they shouldn't get away with it!!!

I know I'm late but his report came out and two days later the fire at my place. Then came the Holidays and I went to Btahurst!!!

But I will be focusing on the report in the next few weeks!!!


So many things have happened since the Racists Cops raided my place. I have met new friends and the support out there was VERY supportive.

Even Councillor Jordan Graham came to my support with this story! I might add it was very risky for the politician to do this because I could have had Child Porn on my computer? I might add a few supporters quickly distant themselves from me until they found out what was in my computer...sad...

Who's Defending Who?



When a person takes the oath of office to become an elected official, they agree to be judged for their service. When government does something, they will be judged. When government doesn’t do anything, they will be judged. Over the course of a term, they accrue a tally of hits and misses that are finally taken to the electorate and the voters present a ruling. Maybe they are rewarded for their work and re-elected. Maybe they are punished and replaced.  An election is society believing that governments should be held accountable for their actions and the citizenry play a critical role by inquiring about the quality of governance they are receiving. The world has seen terrible ideas rejected through this process, and great ideas reinforced. 


Long ago, people would only have personal encounters and stories from friends to base their judgments on. Then some societies opted to protect people that convey the activities of governments such as the press. The citizenry received access to government behavior through the media and improved their ability to draw conclusions and form judgments. Democracy was strengthened. Blogs, Twitter, YouTube and Facebook created the most recent explosion of how information is conveyed and presented. Nearly everyone has a cell phone, and most cell phones have cameras and recorders. Pictures, videos and audio-bits capture live events, and people seek to understand what they see and hear. The proliferation of technology has taken us from blurry encounters with government, to intimate interactions where experiences can be relived by millions of people across the world.


The Arab Spring showed us that democracy is desirable when compared to the alternative. We currently see no societies attempting to revolt against democracy. Just ask yourself how many nations that reject democracy are enticing enough to give up living in Canada for good. Generally, the world has improved greatly with democracy. People want the opportunity to change what isn’t good and hold onto what is. This is advancement.  What is critical to this equation however, is the need to have space for whistleblowers. Democracy needs a society that allows people to say they don’t like the way things are going, no matter how correct or incorrect the subject of criticism might be.


Underpinning all of this is the courage of the whistleblower; the person who challenges the state because they expect a higher standard from their government. Maybe it is a journalist, or maybe a citizen with an experience. Maybe it’s just an observer. Maybe it is a blogger with a video camera.


But what happens when government, the monopoly of force, no longer wants to be criticized? What happens if government acts against that individual to send a message to them and others who may follow? What happens when governments stifle dissent?


I consider what occurred recently in Fredericton, New Brunswick, the city where I serve as a City Councilor an attack on free speech and the ability to challenge government.  Local Blogger Charles Leblanc had his home raided and computer seized by the Fredericton Police Force under what is expected to be the charge of defamatory libel when Leblanc appears in court on April 20th. 2 years ago, Leblanc caught some questionable interactions near the tannery on tape and posted them online. I say questionable, because like myself, many people were shocked by what they saw and wanted an explanation and a court case provided those answers.


Leblanc has been an activist that calls out government on what he thinks is wrong. His comments are colorful and in some cases kooky, but they never incite harm. Why then is the police force flexing muscle 2 years after the incident in question? I have my suspicions, as I am sure that you do as well. Imagine for a second that it was not Charles Leblanc. What if it were a famous humanitarian challenging the police for their actions. Now imagine the humanitarian is taken to task on libel by the very government they were challenging. Wouldn’t we cry bloody murder? We all know government screw up, but from my experience blatant wrong-doings aren't always so. Sometimes things happen that require explanation. But if no one says "hey, wait a minute", the no one gets the explanation. In either case, everyone benefits from having the accountability. The challenge from activists like Leblanc produce either corrections, or explanations. Both are desireable in my books.

Now sure, Leblanc has frustrated a lot of people, but I believe in his sincere goal: he wants tomorrows government to be better than todays, which according to his plan, should be better than yesterdays. Prior to this whole fiasco, he referred to the police as being fascist and operating like the KGB. It sounds crazy coming from him on his bright picket signs, but now it’s less funny


I mean, what are the police doing to show us he’s wrong?

Regardless of the legitimacy the pending charge may have, the damage done by this type of behavior on the part of the FPF could prove to be substantial. Whether it was intended or not, the City of Fredericton is sending a message that nuisances will be silenced, and that people should think twice about taking on the state. After all, if this isn’t a message, then why send 8 officers? Raiding in a situation where literally, the crime is badmouthing someone seems excessive.

The term “libel chill” is used to refer to the effect the laws on defamation have on societal discourse by scaring off harmless and valuable objections. As mentioned, a critical component of effective democracy is the ability to dissent and speak your mind. If people never promote issues to challenge, then government propaganda will be the news. If governments target those who raise flags, people will be too afraid to challenge governments when they’re off mark.

I find this type of behavior to be morally reprehensible and a giant step back for political discourse in Fredericton. We’re all fools if we don’t think the next journalist to call out the police isn’t going to be looking over their shoulder. What does this mean to the quality of information we receive if our journalists are worried about the police? What happens when we make increase the risk of exploiting things that should be talked about and challenged? The stories of governments silencing critics are supposed to trigger stories from the Soviet when challengers disappeared and opposition was intimidated to stay silent. They were not to be reflective of experiences in Canada.

All the progress that we enjoy here in Canada is because of the fact that we have people that can fearlessly stand up and demand better. We have people working to uncover the stories that people don’t want to be told. By protecting their ability to be journalists, or even lunatics about the issues they care for, the pressure remains on the politicians to work toward the goals of the voter.

I personally stand by Charles Leblanc and the important role he plays in politics. We are lucky to have the freedoms we enjoy, but when they come under attack in the most subtle of ways, that is the time to double down and take them back. I chose a world where Charles Leblanc does exactly what he does, especially if the alternative is that government becomes silent to criticism one dissident at a time. There are times when I loathe the very comments he posts, but every November we celebrate the hero’s the lost their lives defending his right to do so.

If the reputation of anyone was truly damaged, have a press conference or do an interview with the media to restore the lost image. This issue needs to be put to bed and sanity needs to be restored to the whole situation. We teach our children in the “sticks and stones” rhyme that name calling shouldn’t hurt us. Let’s maybe for a moment believe it ourselves and stop using force to silence critics.

To paraphrase F.A. Hayek, if you only want freedom when you like the outcome, then you don’t believe in freedom.

Let me leave you with the title of this post: who is defending who? The police are here "to serve and protect", but this act isn't serving anyone but the force itself.

I couldn't believe the amount of people who came to me on the streets and emails wishing to help me with money to get me back on line. I might add the citizens were VERY angry with the Police.

I am very grateful to those people and will never forget...:)

Sometime it gets you down when you're out chasing stories and you wonder to yourself - What are you doing???

But when you get the public support....this keeps you going.

Nobody lost their jobs over this issue. As many people told me - You don't think the Chief retired because of you eh???

My reply - Of course not!! Everyone retires at the age of 49!!!

Our racist police force haven't denounced the Double Standard Policy that was set by Barry MacKnight so this tells me the less fortunate are still in big trouble.

Many things have changed and the New Brunswick Court of Appeal have ruled that the Cops can do their dirty word inside our court system while the less fortunate will not have access to a lawyer.

I will get to those issues in weeks to come.

Myself, I get VERY angry when I think of my privacy being invaded by a bunch of Racists Cops on Steroids!!! I'm trying to get the names of every single one who walked in this place and go after them one by one!!!!

My Family is concerned about my health. My Uncle Al and I had a shouting match during the Christmas Holidays.

 

He knows how stubborn that I am and he knows I can fight for years but he doesn't want me to get into trouble and end up in jail.

He told me that the Cops did the right thing by raiding my place. If the Cops suspects someone to be into child Porn? There's new laws in place that they are allowed to raid a person's home!!!

Well...trust me!! I shot back - YOU'RE FULL OF FUCKING SHIT!!!!

The debate went on and I said - Ok....I suspect a few Cops to be into Child Porn!! When I get back to Fredericton? I'm going to make a few complaints and I expect their places to be raided and of course they could find other stuff like drugs????

New law??? I don't think so!!!!

No...this is far from over and this Blogger haven't been the same since what happened to me one year ago today and probably will never be the same Charles LeBlanc...:(

Lets not forget that I used to be the Cops biggest supporter!!! They couldn't do wrong!!!

 

But all have change and I'm fighting back BIG TIMES!!!!

Maybe they believed that after the raid? I would be afraid of the Cops? I would lower my critical Blogs? I would stay home because I would be afraid to go outside?

People are asking me today if I'm afraid of the Cops and the answer is - NO!!!!

I looked at them eye to eye and ignore those over grown brain dead steroid gorillas!!!

So? Will my health be affected with all this anger inside my body? I'm trying to stay calm but the Scottish Gene will not allow me to do so!!!

Thank God that I walk the Bridges every night!!! This helps me to calm down but when I see those Bastards driving by me? I get angry again!!!

I will continue the Battle for a public Inquiry because we need to eliminate this so-called Police Force!!!

I still say EVERY single one of them should be tested for drugs!!!! They are not thinking straight!!!! Something is VERY wrong with our police force!!!

Here's the DETAIL story of what happened ONE YEAR AGO THIS MORNING - This video was taken minutes after I was release from Jail!

(Fredericton, NB - January 19, 2012) -  In a startling new development today in the case of well known blogger Charles LeBlanc, Fredericton City Police raided LeBlanc's downtown apartment and confiscated all his computer equipment including his monitor, external hard drive and Rogers modem, effectively shutting down his ability to update his website, charlesotherpersonality.blogspot.com, from his home.


In today's incident, Fredericton Police also laid charges of libel under Section 301 of the Criminal Code of Canada, claiming that LeBlanc libelled a Fredericton City Police officer in a blog posting last summer.


"I can't say anything more about it. The police told me I'd spend the next four months in jail if I mention the officer's name. I'll lose my apartment and end up homeless if I go to jail for four months."


Mr. LeBlanc says he caught completely off guard this morning when eight police showed up at his doorstep around 10 am. He was handcuffed, arrested, fingerprinted, photographed and jailed for close to six hours while the police went through his apartment looking for evidence of libel.


During his arrest, LeBlanc says the police asked him for the names of people who helped him with his blog.


"It's very scary stuff," says LeBlanc. "They asked me if anyone helps me with my blog, and if anyone has my username and passwords. They even wanted to know who approached me to be a blogger. Does that mean anybody who associates with me will be arrested too?"


The arrest comes on the heels of Mr. LeBlanc pleading guilty Monday to causing a disturbance last summer in front of the Fredericton City Police station. LeBlanc used a blowhorn to publicize his concerns about the unequal treatment of the poor by the City Police.


Mr. LeBlanc pleaded guilty to the Criminal Code offence Monday after consulting with friends in the social justice community who convinced him that it would be the best thing to do. He received no legal advice and there was no duty counsel available to speak to him on Monday.


"I was in a tough spot so I listened to my friends and pleaded guilty just to get it over with," says LeBlanc, "But right away I knew something was wrong and I decided to appeal. I even blogged that I was going to appeal it."


LeBlanc says someone told him that the police were going to grab him on the street as soon as he  pleaded guilty on Monday, "But I didn't expect it to happen so soon and I certainly didn't expect them to raid my apartment, take all my computer equipment and threaten me with arrest and jail if I dare to mention the officer's name. It's like Soviet Russia."


A Fredericton activist, who asked to withhold his name for fear of retribution, criticized the Police move.


"All this is being done to prevent Charles from going to trial on the bicycle issue (riding his bicycle on the sidewalk) and the reason for that is because they want third party vigalante reporting so they can arrest other people on trumped up charges. Poor people have had this for a long time, single parent women who have been anonymously reported by neighbours because their kids are dirty or under-dressed, the kids are taken away from them and they have to prove they are fit. The only difference is that in Charles' case, they have this high profile guy, Dan Bussieres, the head of security at the legislature, who allegedly made the anonymous complaint against Charles. The police don't want that to come out. We can't have vigalantism in a democratic system, everybody reporting on everybody. It's extremely dictatorial and besides, who are the police to decide what journalists and bloggers say.it's a matter of freedom of speech and boils down to this: do the police have the right to eliminate opinion they don't like? What is this China?"

Here's the story -

I was relaxing with my Female Native friend until 8 to 10 members of the Fredericton Police Force raided my place with guns!!!

Ok...I believe it's time for this Blogger to write a little Blog about the Fredericton Gestapo raiding my place last Thursday!!!



January 19th started very good. My Native friend knocked at my window and asked me if I wanted to go at Tim's Horton for a coffee?



Away we went!!



I suggested to her that she comes inside my place? It would be the very first time she has ever been over my home.



Once inside, she sat in a cozy chair.



She was relaxed and we chatted. It began to get warm so I went to open the curtin of my window.



I sat down and minutes later, I said - WHAT THE FUCK?????



I noticed 8 to 10 plain clothes and uniform Cops walking very fast past my window.

I never saw so many Cops in the area of the City!!



I quickly went for my weapon...

Opppsssss I meant my camera and quickly proceeded to video the action outside of my place.



But little did I knew that I was the action.



They had the key of the building and proceeded right to my door.

Well....it must have been a rush for my Native friend because she quickly stood from her chair and out the door she went.

GONE AND VAMOOSE!!!



Don't blame the poor girl....



So....there I was alone with 8 to 10 cops in my little place.



If I would have been alone? I could have been seriously injured. I'm surprised they never assaulted the Native girl because I did hear the Fredericton Cops were racists against the Natives.



These guys reminded me of the Gestapo!! They were Stone-face like the Nazis!!



It was like I was the enemy!!



I asked - What is this all about???



They told me that it was a Libel charge laid by Police Officer Fred L'Oiseau against the Blogger!!



I quickly shot back - Isn't this suppose to be a civil matter??? You know...a lawyer would send me a letter in my mailbox???



With a smile Racist Cpl. Bobbi Simmons-. Beauchamp told me that it was a Criminal Charge and they have to search my place!!!

I asked - Listen???? Can you bring my neighbor from upstairs in here so she can watch you guys??? I don't want you people to post Child Porn pictures on my computer!! I DON'T TRUST THE FREDERICTON POLICE FORCE!!!!!!!



They answered - Nope!!!



They proceeded to put the handcuff behind my back but I reminded the cops that I had a bad shoulder.



They said - Since we know you? We'll handcuff you with your arm in front of you.

Once again as my arrest with the blowhorn last summer. It was the same cop in charge of my arrest.

It was racist cop Cpl. Bobbi Simmons - Beauchamp!!!



She asked me if I wanted my rights in French?



I answered - You know what? In a situation like this? Yeah!!! I'll have my rights en Francais!!!



This stone-face gestapo cop came along with the name - Carter on his jacket.

I said to myself - Carter???? Francais????



He took a deep breath and began reading my rights. I quicky stopped the guy and said- EN CHIAC!!! JE PARLE LE CHIAC!!!



Sigghhhhhh.....



They wouldn't allowed me back inside my place!



I asked my my medications!!! At first, they wouldn't give it to me but I'm certain they remembered of the public uproar once Staff in the Jail in Saint John denied my medications.



They allowed me to have my medications and to jail we went!!!



It was embarrassing to be escorted in handcuff where everyone can see ya!



Once in jail, they explained to me the charges and put me in a very cold cell!!!



It was like a Gestapo style Squad at the Police Station. Guys like

They guys used to talk to me but this time around they were Stone-Face like Nazis!! They looked brainwashed! They looked at me as I was a piece of shit!!!

Very strange......I will never respect these cops again in my life.

I told one cop and I truly apologize for calling them - Racists!!!

The Cop replied - That's good Charles...

I shot back - You're not racist....YOU'RE GESTAPO!!!!

To the cell I went....

So what do you do with a person with ADHD in a jail cell?

This was beginning to be a habit!!!

All this because of a bicycle!!!

Hours went by and I was wondering what just happened??? This must be a huge nightmare??? Nope!! It was the real thing!!

Others were in Jail for some break and enter issues.

I began to do some sit ups in the cell. Hey? What better way to get in shape?

For hours, nobody came and talk to me until one Acadian Yves Despres came to the scene to speak to me En Chiac!!!

He bought me to a room on the 3rd floor and began asking me questions!!

Such as - Who asked me to become a Blogger??? Who has my user name and password??? What was the name of the girl in my place when I was arrested?

All these questions are useless anyway because the minute I was arrested and bought to jail? I said on camera - Anything I say cannot be held against me because I have ADHD and I speak before thinking. Therefore you can't use what I say in court.

He continued by saying that I should have called the Cop a bad word???

I shot back - HE SHOULD HAVE DID WHAT HE DID!!!!!!!! < More in details >


I felt like I was in China!!!!  Bloggers are shot in that country!!!

So...at the end he bought me back to the Jail cell!!

I laid down on that cement bed and suddenly I got huge pain in the the left side of my side!!!

I quickly called for the guard and she quickly came.

I had my arm up and couldn't move!!!

5 minutes later < took a long time > Matt Myers and others came to see what was going on???

I said - I guess I'm going to die a martyr Blogger!!!! You guys have been trying to killed me since last summer!!! Bye bye cruel world!!!

I felt like Redd Foxx taking the big one!!

You should have seen the looks on these Cops face. They changed from Stone-Face to concern. Can you imagine if the Blogger would have died behind bars?

WOW!!!!


At the end, it was muscle spasm < I think? > on my side from doing these sit ups!!!


Minutes later, I was escorted to an area where I was finger printed and photograph like the criminal the stone-face gestapo Cops believed I was!!!

Then we came to the part where the cops forced a person to sign papers to the point that you'll be release from custody!!


Conditions are important in this case such as the last time the Prosecutor wanted me to signed papers not to be at the corner of Westmorland and Queen Street. I told Judge Julian Dickson that I wouldn't signed those papers because I have to cross the Westmorland Bridge to go to the North Side. I had to used the Westmorland Bridge.

The Judge ordered me in Jail for two days and the Gestapo ordered my medications be cut off. I could have taken a stroke.

Conditions in this case? I can mentioned the name Fred L'oiseau but I can't used his picture or condemn him.

I started to walk toward the cell and said - Lets go to Saint John < Jail > I guess? I'm not signing any papers with conditions.

After around 20 minutes of debating? With no lawyers around to help me decide? I signed the papers.
Someone called the cop and asked if I agreed to the conditions?

The Cop replied- IT'S DONE!!!!

I left the Police Station and made an interview.

I arrived home and I was surprised that all my stuff was gone from my place. They took everything!!!

A code on the wall, hard drive, keyboard, external hard drives, speakers and modem!!

I was confused of the reason they would take all these items???

I returned to the Police Station and demanded some answers???

They told me they could keep all my items after my case is done in court.

Well....I was like a lost dog without its bone.

I came and felt that my privacy have been invaded.

Then I began to think about what the Gestapo Police Force could see in my computer.

All my contacts with the Government, friends and foes.

Will the Fredericton Gestapo begin to arrest my friends???

Will other charge follow????

The word soon spread on the information Highway that the Blogger was once again arrested by the Fredericton Gestapo Police Force!!!

Someone showed up over my place and told me that I could have his computer!!

I reminded the guy that I didn't have a modem! It was no good to me.


The next morning the arrest was all over the News.


Different people from the media circle showed up over my very dirty place....

People began confronting me on the streets with their views and they were very very very upset with our local police.



My answer was always the same - Thank God that I don't smoke Marijuana or into Child Porn!!!



Yes....I might have visited a few Porn Site? < I'm human > but there's no Child Porn on my computer.



They took my external Hard drive with close to 170,000 pictures in there. Are they going to look through all the pictures?



That could take weeks!!!



Who's paying for all this anyway???



Friday evening, I didn't have a computer in my place and I felt like a lost puppy.



A buddy figured that I would be having a hard time so he invited me over his home for a meal and beers!!!!



Even sent me home all drunk up with two bottle of wine for me to enjoy!!!



Very nice...



The next morning, I arrived at the Farmer's Market a little late. < Some vendors were worried because they believe the cops arrested me again >



I quickly found out that many people asked me if I had a computer? People wanted to help. The citizens were very very very upset with the Cops!!!



From the high profile people to the less fortunate. Everyone wanted to help me get back on line so I could continue blogging.



Someone came over with a modem with a message to the Gestapo Cops!

People were giving me money on the streets!!

I told the concern citizens that I was ok and lets see what's going to happen?



The stories was in all the media!!



Monday came and people were still talking about the arrest, They just couldn't believe it.



The media once again came over my place to do a follow up!!!

I received many emailed from people who wanted to donate a computer and money!!!



I was told to go at the Post Office at Shopper's Drug Mart at Kings Place.



Once there, there was a little lined up. I asked the Pharmacist if the media could video me for a few minutes inside the drug store. He agreed!



I noticed a male snob in front of me. He looked very uncomfortable with all the media in the area.

I said - Can I go ahead of you. It will only take a few minutes.



He said- This is just bad timing from my part. I believe that I'll come back another time and he left the area.



I was surprised when the Postal worker told me there was $300.00 in there!!!

It's issues like this that keeps this Blogger going!!!!

A female showed up and I was back on line at around 5:00pm on Monday evening!!!

People been stopping me on the streets and giving me some money but I didn't want it.



Monday evening I showed up at City Hall and joined a Media Scrum asking questions to Racist Police Chief Barry Macknight about the arrest of the Blogger!!

I even joined the scrum and asked a few questions!

One individual told me that I should tell the Police - If you dropped all charges? I will leave the City!!



Why should I leave??? I always promoted this City!!!



Lots of questions and I don't know what's going to happen?



Many suggested that the Cops might post Child Porn on my hard drive?



Could they do that? Once you have a Gestapo Style of Policing? Anything can happen???



I am very grateful to all the people who have step forward with their support, gifts and money.



It's action like this that keeps this Blogger going!



All this could have been settle over a cup of coffee last summer but the Police style of racism of not communicating with the less fortunate bought this issue to a point of no return.



I'm willing to forgot all this and move on in continue to promote this City of being the best place to live in Canada but I don't believe the people in power will want to sit down with me.



This is where this awful mess all began. I made a complaint and the Cops refuse to sit down and talk to me.



Sadly...be ready to see this image in my blog for many years to come.

I don't scare easy but I feel traumatized!!!!



I heard stories from people who are assaulted on the streets and they say that they are not the same again.



I was told that I shouldn't walk alone at night!!! But that don't bother me anyway.



But when i hear foot steps in front of my door? I get edgy!!!



I feel like I'm living in North Korea or China.



I do not trust the Justice system in Fredericton. They have failed the less fortunate and the Judicial Council said that People with mental disabilities who asked questions in court will be jailed!!!!



Nazism in our Court System??? 



There's something VERY VERY VERY wrong with our Police and Justice System!!!

CCLA keeps watch as Fredericton Police Chief attends to information request

March 21st, 2012

The Fredericton Police Chief recently sent word to the CCLA that he intends to fulfill its Request for Information with respect to criminal defamation investigations in the jurisdiction.

On February 29th, 2012, following the arrest of blogger Charles LeBlanc under criminal defamation provisions, CCLA sent the Police Chief a formal Request for Information under New Brunswick’s Right to Information and Protection of Privacy Act. CCLA asked for information on the number of criminal defamation investigations the Fredericton Police Force has undertaken in the last five years, as well as the number of criminal defamation charges it has laid and the disposition of those charges. The Police Chief’s office confirmed receipt of the faxed request on March 1, 2012. On March 7, 2012, CCLA received notice from the Police Chief that data is currently being gathered in view of responding to the formal request.

CCLA expects to receive a response within the required 30 days.

Bernard Richard’s review of the circumstances surrounding the libel charges against Charles LeBlanc by the Fredericton City Police revealed several l weaknesses in the operations of the police in this matter. Blogger Charles Leblanc on many occasions has posted on his blog satirical commentaries and illustrations against the city police, the sergeant at arms Dan Bussieres, and other political figures.

The consequence of his posts resulted in a warrant issued to confiscate his computer and all associated hardware in January of 2012. Leblanc was then arrested for defamatory libel under section 301 of the criminal code which has been found unconstitutional in three jurisdictions. The Canadian Civil Liberties Association and members of the legal academic communities questioned the actions of the Fredericton police in the arrest of Charles LeBlanc and the confiscation of his computer and peripherals.

Subsequently, an independent review of the Fredericton City Police was initiated to see whether or not the Fredericton police force conducted its self appropriately in regards to Charles LeBlanc case.

It was the finding of the review that the Fredericton City Police did follow protocol in obtaining the search and seizure warrant to confiscate Leblanc’s computer and related equipment; however the review identified several weaknesses in the enforcement and judicial system.  Three of the seven recommendations address how the police conduct themselves with unique personality types in the community.

Two of the recommendations were in reference to the scope of the search and seizure and the altering of a document to obtain private information about Charles from Rogers’s Cable his internet service provider.

The investigator Bernard Richard expressed great concerned of the broad scope of the search and seizure policy.  According to Richard, when it comes necessary to issue a warrant to confiscate computers or other digital information stored in electronic hardware the scope that authorizes the warrant should be limited only to collection of information that is relative to the matter under investigation.

“If you get a search warrant to seize a computer you seize everything, everything that is in there, you have access to everything, in my view it’s a bit much.”

Richard recognizes that the current law has not caught up with the information highway and nor with the technology that exists to store personal and not personal information Bernard Richards further adds to his verbal report;

“I think a more specific request when you are obtaining a search warrant for a computer or electronic equipment because there are things that you are computer investing a particular complaint you don't need everything that is in the computer but if you have a search warrant to seize a computer you have everything. so it opens upon all kinds of thoughts, intrusions into a person’s personal life totally unrelated to the investigation taking place, it is also a license to search for stuff.”

From this rational Richards makes the following recommendation “that in all FPF requests for search warrants respecting computer data, every effort should be made to specifically describe the information sought, in addition the Fredericton Police Force provide to all its members a briefing with clear instructions relating to the proper use of the “Letter of request for account information regarding a child sexual exploitation investigation”.

Acting Police Chief Leanne Fitch agreed with Richard’s comment her response to Richards was;

“We have strict parameters in in our court system, I think Mr. Richard raises and very interesting point. that in this day and age of computers and social media, this is something new and we have to catch up in terms of narrowing that scope, the only analogy that I can make is that if we have a search warrant to going into a specific location to finds something specific its very narrow on the search warrant, in this case we have a search warrant to seize a computer so I think there is room for improvement in that area to narrow those fields.”

Other courts in Canada have questioned extent of a search warrant in R. v. Jones, 2011 ONCA 632 ruled in regards to computer and data seizure authorizing a search of the contents of a computer is not unlike authorizing a search of another “place” or of a more expansive search of the same “place”. There seems to be no reason in principle why the state should be any more entitled to roam around through the contents of a person’s computer in an indiscriminate faction that it would be to do so in a person’s home without further authorization.
