Now the battle turns against the Justice Department for some answers!!!

Someone must answer why the prosecutors at the Fredericton office are allowed to force people with mental disabilities with tricky conditions.

Especially the Judicial Council < Judges of New Brunswick > saying that people with mental disabilities are not allowed to asked questions in court.

The battle will continue but without a blowhorn of course...:P

The issue is not that. The REAL issue is the fact that you weren't given a lawyer.

If a person is not given a lawyer then they obviously represent themselves and THEN should be given those answers.

If you have a procedural question, then you had several months to get your questions answered. You could go to the courtroom and watch other cases, and the internet is filled with information.

I'm not letting the government off the hook. I remember when they ran that guy out of town who was helping the less fortunate but wasn't a 'registered lawyer'. That is criminal. If a person doesn't have a lawyer then the government should do as they do in other jurisdictions and provide telephone or email legal help. THAT is the issue, because as you say, many people are simply overwhelmed by the court process. It's criminal that at no point in a public school education are people taught what canada's legal system is like.

To be honest, I'm still not sure what 'questions' you are referring to. If its "why don't I have a lawyer" we already know the answer to that-the province simply doesn't have the money to supply every person with a lawyer. In fact, you could have appealed and sued if you WERE given jail time, because the province (I'm pretty sure I read this) specifically stated that people WOULD be given a lawyer if the charge was serious enough to result in jail time.

If you have a procedural question then there is no reason why you could not have answered that yourself in the many months leading up to the court date. If you have a specific question for the police, then that is what testifying is all about. You said that the police were calling no witnesses, which is another tip off that they weren't serious and you COULD have gotten away with a 'not guilty plea'.

If there are no witnesses, then how does the court know that you used a bullhorn at all? I don't know whether arresting officers are called 'witnesses' or something else, but in either case, if they WEREN"T being called, then all you have to do is ask the judge "if there are no witnesses, then I plead not guilty".

As I said months ago, IF they called the officers who arrested you to the stand, THEN you get to ask them questions to verify their testimony. At that point you could simply ask the officers why they didn't simply seize your bullhorn instead of arresting you.

The one reason that I wish you HAD pled 'not guilty'-even though you clearly were, is that as another poster said, the 'less fortunate' would have more details about the court system and what may ultimately happen to them someday.

I can't begrudge you for that though, years ago I though a video or animation could be done showing the step by step process and didn't exactly rush out to do one, so nobody should expect somebody else to ride out the legal system for a cause when its not necessary. If anybody knows such a video or site, they should post it here.

Exactly where in the 'Judicial Council's' letter to you did it say this? Please quote the section in this space that explicitly makes that statement.
