In case you haven’t already heard, blogger Charles LeBlanc was arrested and charged with libel. Many people have questioned the validity and applicability of the charges. This blog post isn’t going to do that, instead, we will be discussing the seizure of computer equipment for “evidence”.

During the raid, they took his computer, monitor, speakers and cable modem. None of these were actually required as evidence, not even the computer.

Charles’ blog is hosted on blogspot.com, a Google service. His computer has nothing to do with serving web pages. During a normal investigation, the police would subpoena Google to get the IP address of the poster, then subpoena the Internet Service Provider (ISP) to get the owner of the IP address’s account. That is all that is needed as proof. Even with the PC, there is no way they can get any more proof that it was actually Charles sitting in that chair typing those words. In fact, assuming he used the online post editor, there would likely be no trace at all on his computer. Even if they needed to access the computer, there are forensic tools available that will make an image of the hard drive on-site, without the need for a complete seizure.

This is clear evidence that our court system does not understand technology at all. This will be abused. We now know that someone can have IT equipment removed at the mere accusation of libel. How often will we see this being used as an intimidation tactic?

Wrong. They need the source of the offending post, which I will explain in the next rebuttal.

Very very wrong.

An IP can be masked by proxy, spoofed, or otherwise hidden. Charles is not an idiot (but sure acts like it) and has some tech savvy help around him. Also, each PC and network device has a MAC address. To obtain that MAC, you need to have your hands on the physical machine as it is hard-coded on the network card's chip.

As for lack of trace, unlikely. Depending on what tool is used in the forensic investigation on the PC, they should be able to extract the pieces needed to put two and two together

BULLSHIT!

You are ignoring one of the major rules of collecting evidence, especially when it comes to computers. You must protect the evidence. When a copy of the hard drive is made, the original PC is stored away, then the work is done on the hard drive.

Just want to correct the facts, not that LeBlanc will post this, since facts are like poison to him lately.

Some basic rules to using the Internet in the police state. The more you can implement the more secure that you will be:

1) use TOR
2) use a FREE Wifi
3) back up sensitive data offsite using an automated cloud service - double encrypted is best.
4) never delete using a standard operating system. You need to wipe your disk. Use ccleaner by piriform set to 35 passes, wiping free space too. It is free and even the best of the tech spooks can't restore anything from that little baby.

That is more than enough to keep the local gestapo off your back. They are arrogant noobs.

For the real spooks you must take a few extra steps to remain Anonymous but I am damned sure that I am not going to tell anyone here because, quite frankly, if you have to hide your tracks more than what I have just laid out then you are up to something very illegal or clandestine or both.

Remember, remember the 5th of November. The gunpowder, treason, and plot. I know of no reason why the gunpowder treason should ever be forgot.

What you said, WILL NOT BE ENOUGH to hide your tracks boy.

The only true way to wipe your data on your Hard drive is to destroy it. Common means to do the job is Thermite.
